These Terms & Conditions ("Conditions") govern your use of ibvgold.ae (the "Website") and any purchase of gold, silver, platinum or related products ("Products") from IBV Gold FZCO ("IBV Gold", "we", "us", "our"), a company registered in the Dubai Multi Commodities Centre (DMCC) Free Zone, Dubai, United Arab Emirates, under licence number DMCC-307145, with registered address at Unit G-37, Almas Tower, Jumeriah Lake Tower, Dubai, UAE. By accessing the Website or placing an order, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract, and you agree to be bound by these Conditions. If you do not agree, please do not use the Website. Our separate Privacy Policy and Cookie Policy explain how we collect and use personal data, including for identity verification and anti-money laundering (AML) purposes, and form part of these Conditions by reference.

1. Use of the Website

You may use this Website only to browse its content and make legitimate purchases. The Website and its content may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without our prior written consent. Deep-linking, embedding, scraping, or the use of similar technology to access or extract content from the Website is prohibited. Unauthorised use of the Website or its content may infringe applicable copyright, trademark or other intellectual property laws. Nothing on this Website constitutes financial, investment or tax advice. Any decision to purchase precious metals as an investment should be made on the basis of your own judgment or independent professional advice.

2. Our Rights

We reserve the right to:

Modify, suspend or withdraw the Website, or any part of it, at any time, with or without notice, without liability to you, except where required by law;
Change these Conditions from time to time. Changes will take effect for orders placed after the updated Conditions are posted; your continued use of the Website after that point will constitute acceptance of the change. It is your responsibility to review these Conditions periodically;
Monitor activity and content on the Website, investigate suspected violations of these Conditions, and take any action we consider appropriate, including issuing warnings, suspending or terminating access, or removing content.

We will use reasonable endeavours to keep the Website available, but we will not be liable for any loss arising from unavailability of the Website due to circumstances beyond our reasonable control.

3. Onboarding, Identity Verification and Anti-Money Laundering

As a DMCC-regulated precious metals dealer, IBV Gold is subject to UAE anti-money laundering laws and DMCC AML rules, and is required to carry out customer due diligence before completing certain transactions. Accordingly:

We require a valid copy of your passport or Emirates ID and proof of residential address (dated within the last 3 months) as part of our onboarding process, in line with our Privacy Policy;
Payment must be made from your own personal bank account. We do not accept third-party payments. If a third-party payment is received, we will refund it, less a reasonable administration fee to cover the cost of processing and returning the payment;
We accept payment from business/corporate accounts on production of the relevant company documents;
We do not accept cash deposits;
If you collect goods in person from one of our branches, you must bring valid original photo ID for verification before entry and handover;
We may decline, delay or cancel any order where we reasonably consider it necessary for compliance with AML or other legal obligations.

4. Orders, Pricing and Payment

Proof of payment is required no later than the date of order. If proof of payment is not received by that date, the order will be automatically cancelled. Prices are displayed in AED and inclusive of UAE VAT — please confirm treatment per product category, since investment-grade bullion is generally zero-rated while other items may be standard-rated. Listed prices and product specifications are subject to change without notice, including due to movements in underlying commodity or currency markets, or import cost changes. We check pricing and specifications regularly, but errors may occasionally occur; where an error is identified before an order is confirmed, we will contact you before proceeding. Some variation between product images and the physical product may occur. No refunds or returns are accepted.

5. Delivery and Risk

You are responsible for providing a correct and complete delivery address. Risk and title in the goods pass to you once the order has left our premises for delivery, or upon handover if collected in person. No delivery will be arranged until your order has been fully processed and paid in full, and any required verification checks completed. We offer free insurance on delivery of goods, covering loss or damage in transit up to the point of delivery.

6. Returns and Refunds

Given the nature of precious metals as a commodity whose value fluctuates with the market, IBV Gold operates a No Return & No Refund policy for correctly supplied Products that match their order description.

7. Disclaimer and Limitation of Liability

The Website and its content are provided "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. To the fullest extent permitted by UAE law, IBV Gold and its officers, employees and agents ("Providers") will not be liable for any indirect, incidental, special or consequential loss (including loss of data, revenue or profit) arising from your use of, or inability to use, the Website or its content. Nothing in these Conditions excludes or limits our liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited under UAE law.

8. Email Communications

Emails sent from IBV Gold are intended only for the named recipient and may contain privileged or confidential information. If you receive an email in error, please notify us and delete it without disclosing its contents. While we take reasonable steps to keep our emails free of viruses, we cannot guarantee this, and you are responsible for maintaining your own antivirus protections.

9. Complaints

If you have a complaint about your order or our service, please contact us using the details below in the first instance so we can try to resolve it directly. If we are unable to resolve your complaint, you may raise it with the DMCC Authority or, where applicable, the UAE Ministry of Economy's consumer protection department, or pursue the dispute resolution options set out below.

10. Governing Law and Jurisdiction

These Conditions are governed by the laws of the United Arab Emirates and, where applicable, the rules and regulations of the DMCC. Subject to any mandatory consumer protection rights you may have, the courts of Dubai will have jurisdiction over any dispute arising from these Conditions, save that we retain the right to bring proceedings against you in any other jurisdiction where you are based or hold assets.

11. General

Force majeure: We will not be liable for any delay or failure to perform our obligations where this results from circumstances beyond our reasonable control, including natural disasters, government action, customs delays, or disruption to shipping or banking systems.
Severability: If any part of these Conditions is found unenforceable, the remainder will continue in full force and effect.
Entire agreement: These Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and IBV Gold regarding your use of the Website, superseding any prior agreements on the same subject matter.
